ZAŠTITA ODJEVNIH PREDMETA U SISTEMU PRAVA INTELEKTUALNOG VLASNIŠTVA

SAŽETAK:

Članak se bavi pitanjem da li i kako pružiti zaštitu odjevnim predmetima u sistemu prava intelektualnog vlasništva. Odjevni predmeti su prvenstveno korisni, funkcionalni predmeti, ali su istovremeno i odraz ličnog stila i kreativnosti, pokazatelj društvenog statusa i iskaz političkog i dugog mišljenja. Isti odjevni predmet može imati više različitih dizajna, vršeći i dalje svoju osnovnu utilitarističku fukciju. Postoji, dakle, mogućnost razdavajanja funkcije od izgleda i estetskih elemenata odjeće. Činjenica da modna industrija dobar dio svoje historije nije imala nikakvu ili barem ne adekvatnu zaštitu prava intelektualnog vlasništva, a ipak se nastavila razvijati, sugeriše da nedostatak pravne zaštite nije doveo u pitanje kreativnost i produktivnost modnih dizajnera. Da li takav pristup neregulacije i dalje odgovara modnoj industriji u digitalnom dobu, kojeg karakteriše olakšano i ubrzano kopiranje i krivotvorenje? Komparativno pravo pokazuje različite pristupe, ali se uočava trend prihvatanja mogućnosti zaštite odjevnih predmeta kroz različita prava intelektualnog vlasništva, prvenstveno putem autorskog prava i industrijskog dizajna i, u manjoj mjeri, prava žiga.
