IZUZIMANJE UGOVORA O ISTRAŽIVANJU I RAZVOJU OD PRAVNOG DEJSTVA KARTELNE ZABRANE

SAŽETAK:

Inovacije su najznačajniji pokretač ekonomije zasnovane na znanju i samim tim čine osnovu društva znanja. Inovacije nastaju kao rezultat istraživanja i razvoja. Istraživanje i razvoj preduzeća i naučno- istraživačke organizacije mogu sprovoditi samostalno ili u koordinaciji sa drugim preduzećima. Kada se istraživanje i razvoj sprovodi u saradnji sa drugim tržišnim subjektima, onda ugovori o istraživanju i razvoju potpadaju pod norme kartelnog prava. Regulisati ovu pravnu materiju je, upravo zbog značaja istraživanja i razvoja za savremenu ekonomiju i društvo, međutim veliki izazov jer je potrebno uspostaviti balans između zaštite konkurencije i podsticanja tehničko-tehnološkog razvoja. U ovom radu saznajemo kako je ta ravnoteža postignuta u kartelnom pravu Evropske unije.
