САЖЕТАК:

Иновације су најзначајнији покретач економије засноване на знању и самим тим чине основу друштва знања. Иновације настају као резултат истраживања и развоја. Истраживање и развој предузећа и научно- истраживачке организације могу спроводити самостално или у координацији са другим предузећима. Када се истраживање и развој спроводи у сарадњи са другим тржишним субјектима, онда уговори о истраживању и развоју потпадају под норме картелног права. Регулисати ову правну материју је, управо због значаја истраживања и развоја за савремену економију и друштво, међутим велики изазов јер је потребно успоставити баланс између заштите конкуренције и подстицања техничко-технолошког развоја. У овом раду сазнајемо како је та равнотежа постигнута у картелном праву Европске уније.
