Usklađivanje pravnog sistema Srbije sa standardima Evropske unije (2024) (str. 253-267)

SAŽETAK / ABSTRACT:
Da li Republika Srbija može postati članica Evropske unije, uz istovremeno zadržavanje politike vojne neutralnosti? Ovo istraživačko pitanje je postavljeno iz dva ključna razloga. Prvo, u postupku pristupanja Evropskoj uniji (EU), Republika Srbija (Srbija) se obavezala da usvoji i primjeni Acquis Communautaire u svom pravnom sistemu. Izraz Acquis označava sveobuhvatan skup pravnih izvora koji sadrži primarne i sekundarne izvore prava, kao i elemente koji se tiču Zajedničke spoljne i bezbjednosne politike. Kao što je autor na drugom mjestu prethodno napomenuo, ovde posebno mjesto pripada Poglavlju 31, koje se odnosi na politički dijalog sa EU, odnos između države kandidata i institucija EU, angažman u aktivnostima međunarodnih subjekata kao što su UN, OEBS i Savjet Evrope, zajedno sa propisima koji se odnose na kontrolu naoružanja, evropsku bezbjednost i odbrambenu politiku, saradnju sa NATO-om i aktivnostima u borbi protiv terorizma. Drugo, Narodna skupština Republike Srbije je 2007. godine, usvojila Rezoluciju o zaštiti suvereniteta, teritorijalnog integriteta i ustavnog poretka Republike. Ključni aspekt ove rezolucije je deklaracija o vojnoj neutralnosti Srbije, koja je uslovljena istorijskim kontekstom djelovanja NATO-a u regionu. Posebno, stavka o vojnoj neutralnosti je ustanovljena zbog bombardovanja Srbije 1999. godine, koje je počinjeno bez odobrenja Savjeta bezbednosti Ujedinjenih nacija.
