SAŽETAK / ABSTRACT:
With the rapid development of big model technologies such as Chat GPT and Deep Seek, artificial intelligence is profoundly changing the way of production and life, and also giving birth to new forms of technology abuse crime. Based on the recent relevant criminal cases in China, this paper systematically analyses the four types of criminal risks faced by large-scale model technology in the field of digital economy, namely, instrumental, object-based, data-based and autonomous, and explores the realistic dilemmas of criminal justice response from the four dimensions of subject identification, evidence review, law application and governance balance. Finally, it puts forward the path suggestions to build a multi-level and systematic criminal governance system from the three levels of legislative improvement, judicial response and collaborative governance.
