САЖЕТАК / ABSTRACT:

International criminal law is a field of law that, since its earliest interventions, has sought to make sig- nificant contributions in the prosecution and punishment of crimes committed against women.

Although it is easy to conclude that the cases in which the International Criminal Court has intervened are few, it is possible to affirm that its jurisprudence has established important guidelines that can be used within national legal systems. In these contexts, definitions of gender-based violence have been adopted, and efforts have been made to modify procedural rules to eliminate certain discriminatory assumptions and practices.

International courts are only capable of trying a very limited number of individuals cases. Therefore, I believe it is essential at the international level to ensure that national authorities incorporate a gender perspective into their investigations when women are involved.1

Understanding that international law influences local legislation by establishing international standards, the aim of this paper is to define what it means to judge with a gender perspective, explain its scope, out- line existing international standards on the subject, and thereby raise awareness about the importance of applying it in each local legislation. The goal is to ensure that this recognition of fundamental human rights contributes to a more equitable world.
