SAŽETAK / ABSTRACT:
The United Nations Standard Minimum Rules for the Administration of Juvenile Justice (The Beijing Rules) and the United Nations Guidelines for the Prevention of Juvenile Delinquency (The Riyadh Guidelines) explicitly require that the treatment of juvenile offenders prioritize their rehabilitation and social reintegration, advocating for non-custodial and non-institutional measures whenever possible. As a signatory to these conventions, China has established a socialized treatment mechanism for juvenile offenders across different stages of the criminal justice process through the social guardianship system, conditional non-prosecution system, and community-based corrections for minors. This framework not only fulfills the state’s obligations as a contracting party but also effectively reduces recidivism rates among juvenile offenders while providing foundational institutional support for their reintegration into society. Against the backdrop of ongoing profound social transformation, contemporary China must further refine this mechanism by enhancing the integration of enforcement agencies, strengthening social support systems, and improving coordination between socialized and semi-socialized treatment measures.
