САЖЕТАК / ABSTRACT:
Укљученост Европске уније (у даљем тексту: ЕУ) у област дигитализације и дигиталне трансформације је већ добро позната. Не само да су Европска комисија, Савет ЕУ и Европски парламент током 2022. године прогласили Европску Декларацију о дигиталним правима и принципима, већ је исте године на нивоу ЕУ донет (усвојен) тзв. „Пакет дигиталних услуга“ (енгл. Digital Service Package), подељен на два легислативна прописа: „Акт о дигиталним услугама“ и „Акт о дигиталним тржиштима“. Фокус овог рада стављен је на потоњи правни извор, односно Уредбу (ЕУ) 1925/2022 Европског парламента и Савета од 14.09.2022. године о конкурентним и правичним тржиштима у дигиталном сектору и измени Директиве (ЕУ) 1937/2019 и (ЕУ) 1828/2020 (Акт ЕУ о дигиталним тржиштима). Кључне елементе поља примене Акта ЕУ о дигиталним тржиштима (у даљем тексту: Акт ЕУ) чине два концепта – „контролори приступа“ (енгл. gatekeepers) и „основне услуге платформе“ (енгл. core platform services). Мада се поменути елементи у литератури сматрају неодвојивим (концепти близанци, енгл. twin concepts), аутор се у овом раду детаљније бави концептом „контролора приступа“ (енгл. gatekeepers). У фокусу анализе су услови које, у смислу одредби Акта ЕУ, одређена дигитална платформа треба да испуни да би стекла статус „контролора приступa“.
