EVROPSKI ISTRAŽNI NALOG I DIGITALNI DOKAZI: IZAZOVI EFIKASNOSTI I ZAŠTITE OSNOVNIH PRAVA

SAŽETAK / ABSTRACT:

Autor analizira primenu Evropskog istražnog naloga (EIN) u kontekstu pribavljanja i prenošenja digitalnih dokaza unutar Evropske unije. Posebnu pažnju posvećuje izazovima koji proizlaze iz specifične prirode digitalnih podataka – njihove transnacionalnosti, lake izmenljivosti i zavisnosti od tehnoloških provajdera. U radu se ističu problemi efikasnosti i brzine postupka, razlike u nacionalnim zakonodavstvima država članica, kao i pitanja zaštite privatnosti i prava na odbranu. Iako je EIN zamišljen kao instrument koji treba da prevaziđe nedostatke klasične međunarodne pravne pomoći, praksa pokazuje da on nije dovoljan kada je reč o digitalnim dokazima. Upravo zato doneta je Uredba (EU) 2023/1543, koja uvodi nove mehanizme za pribavljanje i očuvanje elektronskih podataka. Autor zaključuje da je potrebno dalje jačanje pravne sigurnosti i ujednačavanje prakse kako bi se postigla ravnoteža između efikasnosti krivičnog gonjenja i poštovanja osnovnih prava.
