SAŽETAK / ABSTRACT:
Restriktivne mere Evropske unije predstavljaju suštinsku aktivnost zajedničke spoljne i bezbednosne politike i odražavaju jedinstvo i koherentnost Unije. U nameri da prevaziđe evidentnu neujednačenost u primeni uvedenih restriktivnih mera (naročito u kontekstu sankcija Rusiji), da smanji mogućnost izbegavanja sankcija i poveća pritisak na ciljane subjekte, EU je preduzele niz mera usmerenih na bolju koordinaciju, preciznije ciljanje i delotvornije pravne mehanizme restriktivnih mera, među kojima je od posebnog značaja kriminalizaciji kršenja uvedenih restriktivnih mera, odnosno dodavanju kršenja sankcija na listu „krivičnih dela EU“. Ovaj potez, formalizovan kroz Direktivu (EU) 2024/1226, obezbeđuje da se kršenje restriktivnih mera smatra krivičnim delom u svim državama članicama, sa propisanim minimalnim kaznama. Direktiva (EU) 2024/1226 se ne primenjuje direktno na Srbiju, budući da Srbija nije članica EU. Međutim, ona je od posebne indirektne važnosti za Srbiju, posebno u kontekstu puta ka punopravnom EU članstvu.
