САЖЕТАК / ABSTRACT:

Суд правде Европске уније донео је 12. јануара 2023. године пресуду којом је потврђено да је предузеће које управља литванском железничком инфраструктуром, противно чл. 102 Уговора о функционисању Европске уније, уклањањем 19 километара пруге на тзв. краћој железничкој рути до Летоније и пропуштањем да пругу на тој деоници обнови, спречило летонског железничког превозиоца да уђе на литванско тржиште услуга превоза робе железницом. Иако железничка инфраструктура испуњава техничке услове да би се правно квалификовала као основно средство (essential facility), на тржишно понашање литванског предузећа није примењена доктрина основних средстава, већ је одговорност за нарушавање конкуренције утврђена на основу општих правила о забрани злоупотребе доминантног тржишног положаја.
