ISKLJUČENJE JAVNOSTI IZ KRIVIČNOG POSTUPKA PREMA MALOLETNICIMA – OPRAVDANOST I DILEME

SAŽETAK / ABSTRACT:

Dok je u krivičnom postupku prema punolentim licima glavni pretres javan, kada se sudi maloletniku javnost se uvek isključuje. U ovom radu, analizira se opravdanost ovakvog rešenja i dileme koje iz njega proističu. Nakon uvodnih razmatranja, autor prikazuje međunarodni pravni okvir za zaštitu privatnosti maloletnika u krivičnom postupku, te objašnjava značaj načela javnosti krivičnog postupka. U centralnom delu rada, autor analizira odredbu o isključenju javnosti u krivičnim postupcima prema maloletnim učiniocima krivičnih dela, razmatrajući njen uticaj na pravo maloletnika na privatnost sa jedne i pravo javnosti na informisanje sa druge strane. U tom smislu, autor  ukazuje i na ulogu medija u postupcima prema maloletnicima, a potom analizira zabranu objavljivanja podataka o toku postupka i odluke donete u tom postupku, te daje zaključna razmatranja o ovoj temi.
