SAŽETAK / ABSTRACT:

Istorijsko iskustvo upozorava da govor mržnje  prethodi zločinu, a nasilje netrpeljivosti, predrasuda i mržnje predstavlja deo dugotrajnog kulturološkog konteksta koji uključuje svakodnevnu, manje ili više vidljivu, praksu marginalizacije ciljanih zajednica. Govor mržnje je u doba savremenih masovnih komunikacija jasno vidljiv i veoma rasprostranjen, a kultura digitalne mržnje je zabrinjavajuće otporna na nastojanja kontrole i suzbijanja govora mržnje. Činjenica da se govor mržnje definiše i razume na različite načine na nacionalnom, evropskom i međunarodnom nivou upućuje na potrebu zajedničkog razumevanja koncepta, prirode i posledica ovog fenomena u cilju razvijanja efikasnije politike i strategije suzbijanja. U radu se razmatraju najkrupnija sporna pitanja (krivično)pravne konceptualizacije govora mržnje: definicija, odnos sa pravom na slobodu govora, odabir zaštićenih grupa, način inkriminisanja govora mržnje, i ukazuje na relevantne standarde.
