ОСУЂЕНИК И/ИЛИ ПАЦИЈЕНТ – ЕТИЧКА И ОРГАНИЗАЦИОНА ПИТАЊА УСЛУГА ЗДРАВСТВЕНЕ ЗАШТИТЕ У ЗАТВОРИМА

САЖЕТАК / ABSTRACT:

Нормативно високо развијена стандардизација пружања услуга здравствене заштите у казнено-поравним заводима не успева да неутралише изразиту некомплементарност између појма здравља и појма затвор. Затвор сам по себи угрожава здравље затвореника, а искуство одласка у затвор у много чему се преклапа са искуством тешке (неизлечиве) болести. Ова унутрашња контадикција отвара и посебну организационо-етичку димензију здравствене заштите у затворима због које услуге здравствене заштите у затворима и даље имају јаку тенденцију да осцилирају у простору између казне и медицинске неге, између контроле и људских права, а осуђеник са здравственим проблемима евидентно (још увек) није у истом положају као и сваки други пацијент. Разлози безбедности неретко могу бити у колизији са принципом потпуне стручне независности медицинског особља и неопходно потребним односом поверљивости између здравственог особља и осуђеника коме је потребна медицинска помоћ и нега. У раду се указује на контрадикторности и комплементарност позиције осуђеник-пацијент и разматрају битна питања етике затворске медицине, као и организациони аспект система здравствене заштите у казненопоправним заводима.
