SAŽETAK / ABSTRACT:
Krivično pravo EU inkriminiše kriminalitet mržnje samo ukoliko je povezan sa ograničenim skupom zaštićenih karakteristika kao što su rasa i etnička pripadnost. EU trenutno nema nadležnost da kriminalizuje govor mržnje i zločin iz mržnje na temelju osnova koji nisu obuhvaćeni Okvirnom odlukom o rasizmu i ksenofobiji. Inkriminacije mržnje u pogledu ostalih zaštićenih grupa (seksualna orijentacija, rod, pol, invalidnost, starosna dob, i slično) značajno se razlikuju na nivou nacionalnog zakonodavstva država članica, što žrtve zločina mržnje dovodi u nejednaku poziciju u odnosu na podršku i prava garantovana pravom EU i otežava policijsku i pravosudnu saradanju. U kontekstu neusklađenih nacionalnih sistema i društvene dinamike kroz koju se razvija normalizacija mržnje evidentna je potreba za višim nivoom usklađenosti krivičnih dela i krivičnih sankcija koje se odnose na zločin mržnje i govor mržnje. U radu se ukazuje na delikatnost regulisanja zločina mržnje u savremenim krivičnom pravu EU i analiziraju proceduralne i sadržinske karakteristike inicijative za proširenje liste „zločina EU“ na govor mržnje i zločin mržnje.
