SAŽETAK / ABSTRACT:
The need to speed up and simplify criminal proceedings is a legitimate demand from society, legislators and law enforcement. Prolongation of criminal proceedings, violation of the requirement of a reasonable time limit, is a complaint in about 10% of all of the Hungarian cases brought before the European Court of Human Rights.
However, acceleration and simplification should not only be a legislative objective because of the actual length of proceedings. The valid need to complete proceedings as soon as possible may arise in the context of ordinary proceedings, where all the conditions for a rapid decision are present, but the application of the general procedural rules necessarily entails a delay in the completion of the proceedings.
The question is therefore how far the legislator can go in modernising and speeding up the procedure, and where the limits are that will halt the plans for modernisation.
This study reviews the notions of acceleration and simplification of criminal procedure and places these needs into the context of Hungarian criminal procedure law.
