САЖЕТАК: 

Za društva za osiguranje u Kini uspostavljen je višeslojni okvir za upravljanje rizicima, uključujući tržišne, administrativne i sudske aspekte. Međutim, nedostatak praktičnosti zakonodavnog okvira najvišeg nivoa i koncentracija regulatorne moći ometali su praktičnu primenu mehanizma za izlazak sa tržišta kroz stečajne postupke. U poređenju sa Sjedinjenim Američkim Državama, Japanom i Velikom Britanijom, postoje značajne razlike u izboru zakonodavnog modela o stečaju društava za osiguranje, standardu za pokretanje stečajnog postupka osiguravajućih društava i granice između administrativnih mera za upravljanje rizicima i sudskih postupaka. Stoga je svrha ovog rada da ukaže na nedostatke kineskog zakonodavstva o uzrocima stečaja osiguravajućih društava, pojašnjenju standarda nesolventnosti osiguravajućih društava i nesmetanoj primeni procedura za stečaj društava za osiguranje.
