SAŽETAK / ABSTRACT:

Naknada štete, predstavlja uz ugovore najčešći izvor obligacija. U oblasti zaštite podataka o ličnosti predviđena su posebna pravila koja se tiču postojanja odgovornosti za štetu. Tek skorijim odlukama Suda pravde Evropske unije su date smernice za tumačenje ovih odredaba. U ovom radu, autor nastoji da primenom pravnodogmatskog i istorijskog metoda najpre ukaže na nedoumice koje su postojale u vezi sa primenom ovih odredaba, a da nakon toga izvrši analizu novije prakse Suda pravde Evropske unije i ukaže na pitanja koja su i dalje ostala otvorena. Cilj rada je da se predstave specifičnosti naknade štete u oblasti zaštite podataka o ličnosti, kako bi se olakšala primena spornih odredaba u praksi.
