САЖЕТАК / ABSTRACT:

Накнада штете, представља уз уговоре најчешћи извор облигација. У области заштите података о личности предвиђена су посебна правила која се тичу постојања одговорности за штету. Тек скоријим одлукама Суда правде Европске уније су дате смернице за тумачење ових одредаба. У овом раду, аутор настоји да применом правнодогматског и историјског метода најпре укаже на недоумице које су постојале у вези са применом ових одредаба, а да након тога изврши анализу новије праксе Суда правде Европске уније и укаже на питања која су и даље остала отворена. Циљ рада је да се представе специфичности накнаде штете у области заштите података о личности, како би се олакшала примена спорних одредаба у пракси.
