SAŽETAK / ABSTRACT:

Pitanje odnosa evropskih integracija i mirovnog procesa u Bosni i Hercegovini u formalnom smislu može da se posmatra kroz prizmu odnosa između komunitarnog prava i Opšteg okvirnog sporazuma za mir u Bosni i Hercegovini. Međusobni odnos ovih izvora je od značaja za Srbiju, kao stranu ugovornicu, u prvom redu kako bi se jasnije sagledala međusobna korelacija i hijerarhija preuzetih obaveza kako Bosne i Hercegovine tako i Srbije. Potreba za ovako postavljenim istraživanjem proizilazi iz očiglednog raskoraka između određenih aspekata Dejtonskog uređenja Bosne i Hercegovine i zahtjeva evrointegracijskih procesa. Glavni zaključci do kojih se došlo tokom istraživanja su da su reformski procesi u BiH koji proističu iz evropskih integracija u suštini primjer neformalne modifikacije međunarodnog ugovora putem naknadne prakse i političkih akata. Iako formalna revizija Dejtonskog mirovnog sporazuma izostaje (sa izuzetkom formiranja Oružanih snaga BiH), praktični efekti evropskih zahtjeva — poput izmjene ustavnih nadležnosti, strukture pravosuđa i izbornog sistema — dovode do suštinske izmjene Dejtonskog mirovnog sporazuma. To ukazuje da u savremenim uslovima regionalnih integracija i fragmentisanih pravnih poredaka, međunarodni ugovori sve više podliježu procesima evolutivne interpretacije i političke modifikacije, što klasična doktrina međunarodnog prava sve teže objašnjava.
