САЖЕТАК / ABSTRACT:

Питање односа европских интеграција и мировног процеса у Босни и Херцеговини у формалном смислу може да се посматра кроз призму односа између комунитарног права и Општег оквирног споразума за мир у Босни и Херцеговини. Међусобни однос ових извора је од значаја за Србију, као страну уговорницу, у првом реду како би се јасније сагледала међусобна корелација и хијерархија преузетих обавеза како Босне и Херцеговине тако и Србије. Потреба за овако постављеним истраживањем произилази из очигледног раскорака између одређених аспеката Дејтонског уређења Босне и Херцеговине и захтјева евроинтеграцијских процеса. Главни закључци до којих се дошло током истраживања су да су реформски процеси у БиХ који проистичу из европских интеграција у суштини примјер неформалне модификације међународног уговора путем накнадне праксе и политичких аката. Иако формална ревизија Дејтонског мировног споразума изостаје (са изузетком формирања Оружаних снага БиХ), практични ефекти европских захтјева — попут измјене уставних надлежности, структуре правосуђа и изборног система — доводе до суштинске измјене Дејтонског мировног споразума. То указује да у савременим условима регионалних интеграција и фрагментисаних правних поредака, међународни уговори све више подлијежу процесима еволутивне интерпретације и политичке модификације, што класична доктрина међународног права све теже објашњава.
