SAŽETAK / ABSTRACT:

Međunarodno krivično pravo (MKP) predstavlja temeljni deo savremenog međunarodnog pravnog poretka, čiji je osnovni cilj sankcionisanje pojedinaca za najteže oblike krivičnih dela protiv čovečnosti, genocid, ratne zločine i zločine agresije. Međunarodno krivično pravo razvijeno je kao odgovor na užase svetskih ratova i masovne zločine koji su potresli savest čovečanstva. Osnovni principi su formulisani u Nirnberškim i Tokijskim procesima, a in- stitucionalizovani kroz uspostavljanjem Međunarodnog krivičnog suda (MKS) 2002. godine. Uprkos institucionalizaciji kroz Međunarodni krivični sud (MKS), primena ovog prava suočava se sa izazovima, pre svega zbog političkog uticaja velikih sila.

Rad koristi komparativnu i kritičku analizu kako bi prikazao značaj i funkciju Međunarodnog krivičnog prava (MKP), njegove ciljeve i problem selektivne primene, posebno u kontekstu delovanja SAD i NATO-a. Jednakost, legitimnost i univerzalnost prava postavljene su kao centralne teme. Teorijska osnova i statistički podaci obogaćuju analizu i ukazuju na potrebu reforme globalnog pravnog sistema.
