ОСВРТ НА ОСНОВНЕ АКТИВНОСТИ КОМИТЕТА УЈЕДИЊЕНИХ НАЦИЈА ЗА ПРАВА ДЕТЕТА

САЖЕТАК:

У раду се даје осврт на основне активности и улогу Комитета УН за права детета као надзорног органа за тумачење и примену Конвенције УН о правима детета. Будући да је Комитет УН за права детета вансудски орган, његова основна улога је надзорно-саветодавна. Отуда, ставови Комитета имају значај „меког права“, односно извора права у материјалном смислу, што не умањује суштинску снагу тумачења правила Конвенције о правима детета.

У том смислу, могу се разликовати три основна поља делатности Комитета. Најпре, Комитет издаје Опште коментаре везане за тумачење и примену појединих права детета или области Конвенције, што има значај аутентичног тумачења. Даље, Комитет усваја и Закључна запажања у односу на примену Конвенције у појединим државама на основу периодичних извештаја које су му државе дужне слати. Коначно, Трећим опционим протоколом уз Конвенцију из 2011, предвиђена је и процедура за упућивање појединачних представки Комитету, уз навођење могућег угрожавања или повреде конкретних права детета од стране одређене државе према индивидуалном детету.
