OSVRT NA OSNOVNE AKTIVNOSTI KOMITETA UJEDINJENIH NACIJA ZA PRAVA DETETA

SAŽETAK:

U radu se daje osvrt na osnovne aktivnosti i ulogu Komiteta UN za prava deteta kao nadzornog organa za tumačenje i primenu Konvencije UN o pravima deteta. Budući da je Komitet UN za prava deteta vansudski organ, njegova osnovna uloga je nadzorno-savetodavna. Otuda, stavovi Komiteta imaju značaj „mekog prava“, odnosno izvora prava u materijalnom smislu, što ne umanjuje suštinsku snagu tumačenja pravila Konvencije o pravima deteta.

U tom smislu, mogu se razlikovati tri osnovna polja delatnosti Komiteta. Najpre, Komitet izdaje Opšte komentare vezane za tumačenje i primenu pojedinih prava deteta ili oblasti Konvencije, što ima značaj autentičnog tumačenja. Dalje, Komitet usvaja i Zaključna zapažanja u odnosu na primenu Konvencije u pojedinim državama na osnovu periodičnih izveštaja koje su mu države dužne slati. Konačno, Trećim opcionim protokolom uz Konvenciju iz 2011, predviđena je i procedura za upućivanje pojedinačnih predstavki Komitetu, uz navođenje mogućeg ugrožavanja ili povrede konkretnih prava deteta od strane određene države prema individualnom detetu.
