САЖЕТАК:

Аутор у раду се бави проблемом заптите рањивих категорија сведока у контексту давања исказа на главном претресу, а све у смислу права на правично суђење у јуриспруденцији Европског суда за људска права. Један од проблема у примени чл. 6. Европске конвенције о људским правима је повезан са исказима сведока у предметима са елементима полних злоупотреба у кривичном поступку. Судска пракса Европског суда за људска права развила је одређене критеријуме који морају бити пропраћени у националним законодавствима, превасходно пратећи Al-Khawaja and Tahery тест. Истовремено, на овом пољу од посебне важности је и Директива Европске уније о успостављању минималних стандарда о правима, подршци и заштити жртава криминалитета 2012/29/ЕУ. Након уводних разматрања аутор објашњава релевантне одредбе поменуте директиве, те судску праксу Суд у погледу заштите сведока у предметима полних злоупотреба.
