SAŽETAK:

Savet Evropske unije odlučio je 19. i 20. aprila 2007. godine da definiše stav Veća o osnovnim aspektima mogućeg zajedničkog referentnog okvira (CFR) za evropsko ugovorno pravo. Ovo je bio još jedan korak u velikom evropskom projektu čiji je cilj izgradnja zajedničkog evropskog ugovornog prava, jer je zakonodavac EU shvatio da jedinstvena materijalna pravila obezbeđuju veću predvidljivost od ujednačenih pravila o pravu izbora, iako se nadležnosti Zajednice u ovom polju i dalje razmatraju. Prvi deo rada se bavi položajem i funkcijom zajedničkih evropskih pravila u pogledu ograničenja slobode ugovora i uloge obaveznih i neobaveznih pravila uopšte. Drugi deo se bavi različitim tehnikama koje ograničavaju slobodu ugovora koje nalazimo u Principles of European Contract Law – PECL (Principi evropskog ugovornog prava PECL), acquis communautaire, ili nacrtu „zajedničkog referentnog okvira“ (CFR).
