ABSTRACT / САЖЕТАК:

Wildfires have intensified in frequency and severity due to climate change and human activity, generating profound ecological and social consequences. Among these effects, forest migrations-shifts in species distribution following fire induced environmental disruption-and human displacement remain insufficiently explored in legal scholarship. This article examines the intersection between wildfire driven ecological change and forced migration, assessing their relevance for criminal law in Spain and Serbia. It analyzes the ecological mechanisms of post fire forest migration, the social dynamics of wildfire induced human displacement, and the limitations of current international law in recognizing environmental migrants. The study compares Spanish and Serbian criminal frameworks, highlighting differences in the treatment of ecological harm, land use restrictions, and restoration obligations and concludes that addressing wildfire related migration requires a multidisciplinary approach capable of responding to long term ecological transformations and emerging forms of vulnerability.
