INTERNATIONAL CRIMINAL LAW AND ENVIRONMENTAL PROTECTION IN GREECE, FROM A BIOETHICAL AND BIOPOLITICAL PERSPECTIVE

ABSTRACT / САЖЕТАК:

This article analyzes the dynamic evolution of international criminal law as a mechanism for environmental protection, with an emphasis on the case of Greece compared to other countries. The gradual criminalization of serious environmental damage and the emerging concept of “ecocide” as a potential international crime are examined, within the framework of the International Criminal Court and the Rome Statute. The study highlights that, despite significant regulatory progress at the international and European level, there is a significant gap between institutional provision and practical implementation in Greece and the Western Balkan countries. Greece presents greater institutional maturity, without however being devoid of functional weaknesses in law enforcement. Under the light of Bioethics and Biopolitics, the environment is redefined as a fundamental good, inextricably linked to human dignity, public health and collective survival. Environmental damage is no longer treated only as a legal violation, but as a structural threat to societies and future generations. The article concludes with the need to strengthen international and national criminal protection through institutional unification, specialization of enforcement mechanisms and development of new forms of international responsibility, with the aim of establishing a coherent, effective and sustainable regulatory framework that will help the qualitative future of civil society.
