SAŽETAK / ABSTRACT:
Autor u radu analizira usluge presretanja telekomunikacija u krivičnom postupku. Prvenstveno analizira normativni okvir i objašnjava na koji način u krivičnom postupku može doći do zahtevanja različitih vrsta usluga u vezi sa telekomunikacijama. Poseban akcenat stavlja na zaštitu ljudskih prava prilikom primene posebne dokazne radnje tajnog nadzora komunikacije. Zatim autor analizira upotrebu ostvarenog mobilnog saobraćaja prilikom rasvetljavanja krivičnog dela silovanje. Autor testira dve hipoteze. Prvom hipotezom smatra da sadržina mobilne komunikacije može da predstavlja dokaz prilikom dokazivanja navedenog krivičnog dela. Drugom hipotezom pretpostavlja korišćenje lociranja položaja mobilnog telefona i povezivanja učinioca sa mestom učinjenja krivičnog dela. Analizom sudske prakse autor potvrđuje obe hipoteze.
