SAŽETAK / ABSTRACT:

Za razliku od tradicionalnog pojma prodaje, prema kome bi održavanje digitalnih elemenata robe moglo biti predmet ugovora mešovite pravne prirode ili povezanog ugovora o pružanju usluga, u savremenom evropskom (potrošačkom) ugovornom pravu prihvaćen je fleksibilniji pristup. Imajući u vidu specifične zahteve u vezi sa digitalnim proizvodima, značajnu inovaciju, sa opsežnim posledicama po ugovornu praksu, predstavlja naročito uključivanje obaveze ažuriranja u pojam saobraznosti. Potreba za takvom „dinamizacijom“ je posebno naglašena u pogledu sigurnosnih ažuriranja. Međutim, obaveza ažuriranja nije ograničena samo na njih. Osim ažuriranja predviđenih ugovorom, prodavac je dužan da obezbedi ažuriranja koja su neophodna kako bi roba sa digitalnim elementima ostala saobrazna. Propisivanjem obaveze ažuriranja doprinosi se obuzdavanju prerane (često planske) tehnološke zastarelosti robe sa digitalnim elementima. Ovaj objektivni zahtev u pogledu saobraznosti ne predstavlja nesrazmerno opterećenje za prodavca, jer podleže mogućnosti kvalifikovanog odstupanja. Takođe, u slučaju nepružanja neophodnih ažuriranja, prodavac ima pravo na pravna sredstva protiv odgovornog lica u lancu pravnih poslova. S obzirom na povećan značaj uslužne komponente u ugovorima o prodaji robe u (sve više) digitalizovanom svetu, obaveza ažuriranja trebalo bi da važi i u odnosima između privrednih subjekata.
