SAŽETAK:
U ovom tekstu autori analiziraju razloge za prihvatanje mogućnosti da strane međunarodnih trgovinskih transakcija same regulišu vlastita prava i obaveze putem izbora merodavnog prava. Osnovna premisa iz koje polaze autori je sloboda ugovaranja kao osnovni postulat obligacionog prava i potrebe za pravnom sigurnošću i predvidljivost pravnih sistema. Ukoliko strane samostalno stupaju u poslovne odnose, samostalno odlučuju da li će koristiti određene usluge, onda se može očekivati i da same mogu materijalno-pravno regulisati te odnose sa jedne strane, ali i da odaberu merodavno pravo u kolizionom smislu sa druge strane.
