PORODIČNOPRAVNI STATUS VANBRAČNOG PARTNERA RODITELJA DETETA

SAŽETAK / ABSTRACT:

Uprkos nepostojanja srodničkog odnosa, u domaćem i savremenom porodičnom pravu, između deteta i vanbračnog partnera roditelja deteta mogu postojati ili se uspostaviti određena prava i obaveze. U uslovima sve većeg broja rekomponovanih porodica, danas više nisu retki slučajevi da dete živi sa jednim roditeljem i njegovim ili njenim vanbračnim partnerom, pa se postavlja pitanje kako regulisati porodične odnose između navedenog lica i deteta.

U kontekstu porodičnopravnog statusa vanbračnog partnera roditelja deteta mogu se prepoznati nekoliko ključnih pitanja, poput problema učešća u faktičkom staranju o ličnosti deteta, zasnivanja usvojenja, prava na održavanje ličnih odnosa i mogućnosti zakonskog izdržavanja. U radu se daje prikaz porodičnopravnog položaja vanbračnog partnera roditelja deteta u domaćem zakonodavstvu, uz analizu opravdanosti pojedinih zakonskih rešenja i osvrt na uporedno pravo, interese deteta i praksu Evropskog suda za ljudska prava. Tumačenjem važećih porodičnih propisa daje se odgovarajući predlog eventualnih zakonskih izmena kako bi se odgovorilo na sporna pitanja, između ostalog, i na pitanje može li se uspostaviti odnos zakonskog izdržavanja između vanbračnog partnera roditelja deteta i deteta.
