ПРАВО ДЕТЕТА НА ИМЕ И ГРАНИЦЕ РОДИТЕЉСКЕ АУТОНОМИЈЕ

САЖЕТАК / ABSTRACT:

Право детета на име је важан сегмент формирања идентитета детета који се остварује од самог тренутка рођења. Као такво, оно представља ужи израз права на идентитет које гарантује чл. 64. Устава РС и чл. 7. Конвенције УН о правима детета. Истовремено подразумева дужност родитеља да заједнички и споразумно одреде лично и породично име детету уз најшири могући степен њихове аутономије. Иако је та аутономија једна од најширих у домену вршења родитељског права, она подлеже одговарајућим ограничењима. Начин на који државе лимитирају родитељску моћ у одређивању имена детета је резултирао различите системе на нивоу европског правног простора. У раду су анализиране границе родитељске аутономије постављене од стране националних законодавстава на основу принципа најбољег интереса детета који треба да буде основна брига родитеља и принципа партиципације, оличеног у праву детета на мишљење у каснијој фази развоја детета. Поврх тога, принцип недискриминације захтева да се избегне аутоматско одређивање породичног имена детета по презимену једног од родитеља уколико се она разликују.
