SAŽETAK / ABSTRACT:

Autor u radu daje prikaz nastanka i razvitka kazne građanske smrti u anglosaksonskom i kontinentalnom pravu. Autor se opredelio da pri analizi kontinentalne varijante ove kazne posveti pažnju francuskom pravu kao najreprezentativnijem krivično-pravnom sistemu u Evropi XIX veka.

Analizom zakonskih tekstova, sudskih presuda, starije i novije literature, autor daje komparativni prikaz posledica građanske smrti u ova dva najvažnija evropska i svetska pravna sistema, kao i mišljenja pristalica i oponenata ove kazne. Iako se na tlu Evrope smatra kaznom koja pripada prošlosti, u anglosaksonskom pravnom sistemu građanska smrt je i dalje predmet veoma živog diskursa.
