САЖЕТАК / ABSTRACT:

Аутор у раду даје приказ настанка и развитка казне грађанске смрти у англосаксонском и континенталном праву. Аутор се определио да при анализи континенталне варијанте ове казне посвети пажњу француском праву као најрепрезентативнијем кривично-правном систему у Европи XIX века.

Анализом законских текстова, судских пресуда, старије и новије литературе, аутор даје компаративни приказ последица грађанске смрти у ова два најважнија европска и светска правна система, као и мишљења присталица и опонената ове казне. Иако се на тлу Европе сматра казном која припада прошлости, у англосаксонском правном систему грађанска смрт је и даље предмет веома живог дискурса.
