ABSTRACT / САЖЕТАК:
Pariski sporazum propisuje klimatski cilj usklađivanja privrednih tokova sa ograničenim emisijama gasova staklene bašte (GHG) i razvojem otpornim na klimu. Kolektivni napredak u postizanju cilja Pariskog sporazuma i njegovih dugoročnih ciljeva prvi put je procenjen krajem 2023. godine („globalni pregled”). Prvi globalni pregled beleži ograničen napredak usmeravanja tokova finansija ka ostvarivanju smanjivanja emisija GHG i razvoju snabdevanja energijom otpornom na klimu. Shodno tome, poziva zemlje da doprinesu utrostručenju globalnog kapaciteta obnovljive energije i ubrzaju prelazak sa fosilnih goriva u energetskim sistemima. Međunarodni investicioni sporazumi propisuju standarde tretmana stranih investitora u zemljama domaćinima i, u slučaju navodnog kršenja takvih standarda, obezbeđuju stranim investitorima nezavisne međunarodne arbitražne tribunale.
U tom kontekstu, rad će prvo predstaviti međunarodni pravni okvir koji se odnosi na energetsku održivost. Drugo, predstaviće odredbe u novopotpisanim međunarodnim investicionim sporazumima koje su od značaja za energetsku održivost, s posebnim fokusom na sporazume ratifikovane od strane Srbije. Treće, fokusiraće se na arbitražnu praksu relevantnu u kontekstu energetske održivosti. Na kraju, rad će se završiti preporukama za usklađivanje međunarodnog režima ulaganja sa pitanjima energetske održivosti.
