ABSTRACT / SAŽETAK:

Analiza razvojnih etapa izgradnje usklađenog sistema zaštite ljudskih prava u Evropi je usmerena na pravni aspekt njihove evolucije upotrebom, između ostalog, istorijskopravnog i uporednopravnog metoda. U radu će se najpre predstaviti proširenje nadležnosti Suda pravde EU i Evropskog suda za ljudska prava, kao i na koji način su oni pokušali da spreče razvoj neusaglašene zaštite ljudskih prava u Evropi. Nakon toga, predstaviće se napori koji su preduzimani na putu realizacije ideje pristupanja EU, tačnije nekadašnje Evropske zajednice Evropskoj konvenciji, koji do sada nisu dali očekivane rezultate. Zbog ponovnog aktuelizovanja pitanja pristupanja EU Evropskoj konvenciji, bitno je osvrnuti se na dosadašnje napore koji su činjeni na putu izgradnje usaglašenosti u evropskom poretku zaštite ljudskih prava u cilju što sveobuhvatnijeg sagledavanja problema koji i dalje nisu prevaziđeni, kao i izvlačenja zaključaka iz dosadašnjih iskustava.

Ovo istraživanje je nastalo u okviru naučnoistraživačkog rada Instituta za uporedno pravo koji finansira Ministarstvo nauke, tehnološkog razvoja i inovacija Republike Srbije prema Ugovoru o realizaciji i finansiranju naučnoistraživačkog rada NIO u 2024. godini (evidencioni broj: 451-03-66/2024-03/200049 od 05. 02. 2024). Osnovu za pisanje ovog rada predstavlja istraživanje koje je koautorka dr Vesna Ćorić sprovela u okviru pripreme izrade svoje doktorske disertacije „Odnos Evropskog suda pravde i Evropskog suda za ljudska prava” koja je odbranjena na Pravnom fakultetu Univerziteta u Beogradu 2013. godine (UDK: 341.645(4)).
