SAŽETAK / ABSTRACT:

Pravo deteta na ime je važan segment formiranja identiteta deteta koji se ostvaruje od samog trenutka rođenja. Kao takvo, ono predstavlja uži izraz prava na identitet koje garantuje čl. 64. Ustava RS i čl. 7. Konvencije UN o pravima deteta. Istovremeno podrazumeva dužnost roditelja da zajednički i sporazumno odrede lično i porodično ime detetu uz najširi mogući stepen njihove autonomije. Iako je ta autonomija jedna od najširih u domenu vršenja roditeljskog prava, ona podleže odgovarajućim ograničenjima. Način na koji države limitiraju roditeljsku moć u određivanju imena deteta je rezultirao različite sisteme na nivou evropskog pravnog prostora. U radu su analizirane granice roditeljske autonomije postavljene od strane nacionalnih zakonodavstava na osnovu principa najboljeg interesa deteta koji treba da bude osnovna briga roditelja i principa participacije, oličenog u pravu deteta na mišljenje u kasnijoj fazi razvoja deteta. Povrh toga, princip nediskriminacije zahteva da se izbegne automatsko određivanje porodičnog imena deteta po prezimenu jednog od roditelja ukoliko se ona razlikuju.
