ABSTRACT / САЖЕТАК:

This paper examines the evolving legal reality between Greece and Serbia through the lens of three pivotal European Union regulations: the Digital Services Act (“DSA”), the Digital Markets Act (“DMA”), and the Artificial Intelligence Act (“AI Act”). While Greece, as an EU Member State, is already in the process of transposing these legislative frameworks into national law, Serbia – a candidate country – faces the challenge of aligning with this rapidly evolving new regulation. This essay explores the surface of possible legal challenges and practical enforcement issues that exist or may exist within the framework of the two nations’ market relationship.

Given Serbia’s accession obligations, along with the fact of already existing and possible future Greek-Serbian multi-faceted market relations, the essay aims to showcase how extraterritoriality in digital regulation may impact non-EU partners. The Greek perspective is hereby utilized to assess how Greek competent authorities — including the Hellenic Telecommunications and Post Commission (EETT) and the Hellenic Data Protection Authority (HDPA) — approach enforcement and cross-border compliance issues.

Ultimately, this research proposes the possibility of building a structured framework for digital legal convergence between Greece and Serbia, advocating for stronger bilateral cooperation, regulatory dialogue, and harmonized enforcement strategies. The findings showcase Greece’s potential role as a normative bridge in regional digital governance, while identifying key legal and technical challenges that must be addressed to ensure a digital regulation that respects the European acquis, and its adjacent human-centric and rights/liberties’ respectful regulation, in Southeast Europe.
