LJUDSKA PRAVA U KORPORATIVNOM OKRUŽENJU

Društvena kretanja i promene doprinose izmeni shvatanja položaja privrednih društava i njihove uloge. U skladu sa konceptom održivog poslovanja koji zauzima sve većeg maha u svetu poslovnog prava, poseban aspekt održivosti privrednih društava jeste upravo društvena (socijalna) održivost. Ispunjenje društvene održivosti podrazumeva da privredna društva u svojim aktivnostima poštuju ljudska prava i obezbede poštovanje jednakosti. Obaveze privrednih društava koje proizilaze iz društvene održivosti odnose se na obaveze u internom krugu poslovanja, odnosno na obaveze prema zaposlenima. Pored toga, privredna društva su obavezna da u svom poslovanju imaju u vidu interese šire društvene zajednice. U ovom radu će se najpre analizirati društvena održivost privrednih društava, razlažući prema kategorijama šta sve ona podrazumeva. Centralni deo rada biće posvećen analizi najznačajnijih ljudskih prava koja privredna društva moraju da imaju u vidu u svom poslovanju, a čije poštovanje predstavlja suštinu društvene održivosti privrednih društava. To su pravo na rodnu ravnopravnost, prava zaposlenih i pravo na zdravu životnu sredinu. Ona će se u radu obraditi iz ugla obaveza koja na osnovu trenutnog regulatornog okvira privredna društva imaju u pogledu njihovog poštovanja.
