SKANDINAVSKI MODEL PRAVNOG UREĐENJA REGISTROVANOG PARTNERSTVA

SAŽETAK:

Pravno prepoznavanje i uređenje određenog oblika istopolnih zajednica predstavlja međunarodnu obavezu Srbije, proisteklu iz formirane prakse Evropskog suda za ljudska prava. U radnoj verziji teksta Zakona o istopolnim zajednicama koju je pripremilo Ministarstvo za ljudska i manjinska prava Republike Srbije predlaže se uvođenje registrovanog partnerstva, kao novog oblika partnerske zajednice. Pri tome, tvorci navedenog nacrta Zakona prihvataju skandinavski model regulisanja registrovanog  partnerstva kreiran isključivo kao zajednica osoba istog pola, za čije zaključenje su potrebni određeni formalni uslovi. To je dualistički pristup, prema kome brak pripada heteroseksualnim parovima, dok je registrovano partnerstvo rezervisano za lica istog pola. Međutim, iskustvo skandinavskih zemalja ukazuje da model registrovanog partnerstva predstavlja samo privremenu fazu do omogućavanja zaključenja istopolnih brakova. Navedena faza nije, niti bi mogla biti kratkotrajna, budući da se zakonodavne promene kojima se proširuju prava istopolnih parova odvijaju postepeno. Autor u radu analizira pomenuti model, te ukazuje na njegove osnovne prednosti i nedostatke.
